These Terms & Conditions apply to entries and participation in events forming part of the Northern Sidecar Cup (“NSC”).

By submitting an entry for a NSC event, the entrant, team, rider and passenger confirm that they have read, understood and accepted these Terms & Conditions, together with the sporting, technical and supplementary regulations applicable to the relevant event.

For the purposes of these Terms & Conditions, “Organizer” means the organizer or organizing entity responsible for the Northern Sidecar Cup.

1. ENTRY AND ACCEPTANCE

Submitting an entry form and/or paying an entry fee does not automatically create a right to participate in an NSC event.

All entries are subject to acceptance by the Organizer.

The Organizer reserves the right, at its discretion and to the extent permitted by applicable law and regulations, to:

• accept or refuse an entry;
• place an entry on a waiting list;
• impose reasonable conditions on acceptance;
• withdraw or revoke an accepted entry; or
• exclude a team, rider or passenger from participation.

Where permitted by applicable law and sporting regulations, the Organizer is not required to provide a reason for refusing or withdrawing an entry.

Acceptance of an entry does not guarantee that the event will take place or that the entrant will be permitted to start or complete every practice session, qualifying session or race.

2. ENTRY FEES AND REFUNDS

Entry fees must be paid in accordance with the payment terms communicated by the Organizer.

Payment of an entry fee does not create an unconditional right to participate.

Where an entry is refused, withdrawn, cancelled or revoked, any refund or partial refund of the entry fee shall be determined by the Organizer at its discretion, taking into account the circumstances and any costs already incurred.

Where a competitor withdraws voluntarily, fails to attend, fails scrutineering, is declared ineligible, is excluded for sporting, technical, administrative, safety or conduct reasons, or otherwise does not participate, there is no automatic entitlement to a refund.

Any refund remains subject to applicable mandatory law and any applicable regulations that cannot legally be excluded.

Entry fees are separate from any costs incurred by competitors in preparing for or attending an event.

3. COMPETITOR EXPENSES

All costs connected with participation are the responsibility of the entrant and/or team.

These may include, without limitation, travel, ferries, fuel, accommodation, transport, licences, insurance, tyres, parts, repairs, catering and preparation costs.

The Organizer shall not be responsible for such expenses where an event or entry is cancelled, changed, postponed or withdrawn, except where liability cannot lawfully be excluded.

4. LICENCES AND ELIGIBILITY

Each rider and passenger is responsible for holding all licences, permissions, medical certificates, start permissions and other documentation required to participate in the relevant event.

Competitors participating outside their home country are responsible for obtaining any additional permissions required by their national federation or the applicable motorsport authority.

The Organizer may request evidence of eligibility at any time.

Acceptance of an entry does not constitute confirmation by the Organizer that a competitor satisfies all licensing or eligibility requirements.

5. TECHNICAL AND SAFETY REQUIREMENTS

Every entrant is responsible for ensuring that their sidecar, equipment, clothing and protective equipment comply with all applicable technical and safety regulations.

The sidecar must be presented for technical inspection or scrutineering when required.

Passing scrutineering does not transfer responsibility for the safety, legality or mechanical condition of the sidecar to the Organizer, scrutineers, officials or circuit.

The rider and passenger remain responsible for deciding whether their machine and equipment are safe to use.

The Organizer and/or event officials may prevent a sidecar from participating where there are reasonable safety, technical or regulatory concerns.

6. SPORTING AND EVENT REGULATIONS

Competitors must comply with all applicable:

• NSC sporting and technical regulations;
• supplementary event regulations;
• regulations of the relevant motorsport federation or sanctioning body;
• circuit regulations;
• paddock and pit-lane rules;
• environmental regulations;
• safety requirements; and
• instructions issued by authorized officials.

Where there is a conflict between these Terms & Conditions and mandatory sporting or federation regulations, those mandatory regulations shall prevail to the extent of that conflict.

7. RIDER AND PASSENGER CHANGES

Any change of rider or passenger after submission of an entry must be communicated to the Organizer as soon as reasonably possible.

A substitute rider or passenger may participate only where permitted by the applicable regulations and accepted by the Organizer and/or relevant officials.

Acceptance of one team configuration does not automatically constitute acceptance of a substitute rider or passenger.

8. CONDUCT

All competitors, team members and persons associated with an entry are expected to behave responsibly and respectfully.

Abusive, threatening, discriminatory, dangerous or seriously disruptive behaviour toward officials, volunteers, other competitors, circuit staff, spectators, sponsors or other persons involved with an event may result in action by the Organizer and/or relevant officials.

The Organizer may also act where the conduct of a competitor or team seriously damages the proper running, safety or legitimate reputation of the Northern Sidecar Cup.

Depending on the circumstances and applicable regulations, measures may include warnings, removal from the paddock, withdrawal of an entry or exclusion from future NSC events.

9. PADDOCK, PIT LANE AND CIRCUIT RULES

Teams must follow all paddock, pit-lane and circuit rules.

Vehicles, awnings, equipment and team facilities must be positioned only in authorized areas.

Competitors are responsible for the behaviour of their team members and guests insofar as permitted by applicable rules and law.

The paddock and pit lane are working motorsport environments. All persons must behave accordingly and comply immediately with reasonable safety instructions.

10. ALCOHOL, DRUGS AND IMPAIRMENT

Riders and passengers must not participate while impaired by alcohol, illegal drugs, prohibited substances or medication that makes participation unsafe.

Applicable anti-doping and federation regulations remain fully applicable.

The Organizer and/or event officials may prevent participation where required or permitted under the applicable regulations.

11. ASSUMPTION OF MOTORSPORT RISKS

Motorsport is inherently dangerous.

Participation may involve serious risks, including collision, mechanical failure, fire, injury, permanent disability and death.

Each participant is responsible for understanding the risks associated with motorsport and for complying with the liability declarations, waivers, insurance requirements and other documentation required by the relevant circuit, federation, sanctioning body or event organizer.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

12. INSURANCE

Competitors are responsible for ensuring that they have any personal accident, medical, travel, vehicle or other insurance they consider appropriate, in addition to any compulsory insurance provided or required through the event, circuit or motorsport federation.

The existence of event insurance should not be assumed to cover every loss, injury, expense or circumstance.

Competitors should establish the scope of applicable insurance before participating.

13. EVENT CHANGES

Motorsport events are subject to changing circumstances.

The Organizer and/or relevant event authorities may, where reasonably necessary, alter:

• timetables;
• practice or qualifying arrangements;
• race distances;
• race formats;
• starting procedures;
• paddock arrangements;
• technical or administrative procedures; or
• other organizational aspects of an event.

Such changes do not automatically create a right to a refund.

14. POSTPONEMENT, INTERRUPTION AND CANCELLATION

An event or part of an event may be postponed, interrupted, shortened or cancelled because of circumstances including, but not limited to:

• adverse weather;
• unsafe track conditions;
• accidents or emergencies;
• decisions by race control or officials;
• circuit availability;
• government or public-authority decisions;
• federation decisions;
• failure or interruption of essential infrastructure;
• force majeure; or
• other circumstances outside the Organizer’s reasonable control.

In such circumstances, the Organizer will determine whether an entry fee or part of an entry fee can be refunded or credited toward another event, subject to applicable law and regulations.

The Organizer is not responsible for competitors’ consequential expenses such as travel, accommodation or vehicle costs except where liability cannot lawfully be excluded.

15. CHAMPIONSHIP POINTS AND RESULTS

Championship points and classifications will be determined in accordance with the applicable NSC sporting regulations.

Official event results, penalties, exclusions and decisions issued by authorized officials will be used for championship purposes unless subsequently amended through an applicable official procedure.

Any protest or appeal must be made through the procedure provided by the applicable sporting regulations.

16. TIMING AND TRANSPONDERS

Where electronic timing or transponders are required, competitors must comply with the instructions provided by the Organizer or timing service.

Teams are responsible for correctly fitting and maintaining any transponder assigned to them.

Competitors may be charged for lost, damaged or unreturned equipment where applicable.

17. PHOTOGRAPHY, VIDEO AND MEDIA

NSC events may be photographed, filmed, livestreamed or otherwise recorded.

To the extent permitted by applicable law, participants acknowledge that images, video and audio captured during NSC events may be used by the Organizer for legitimate editorial, promotional, championship, historical and communications purposes, including on websites, social media and promotional materials.

Where separate consent is legally required for particular uses, the Organizer will obtain such consent as required.

Teams remain responsible for obtaining appropriate permissions for commercial filming or media activity they conduct themselves where required by the circuit or event organizer.

18. TEAM AND SPONSOR IDENTIFICATION

Competitors may be required to display championship numbers, identification, decals or other material required under NSC sporting regulations or event regulations.

Teams remain responsible for ensuring that their own sponsor branding and advertising comply with applicable laws, circuit requirements and sporting regulations.

19. PERSONAL DATA

Personal information supplied as part of an entry may be processed for purposes reasonably necessary to administer the Northern Sidecar Cup and its events.

This may include entry administration, eligibility checks, communication, timing, results, championship standings, safety administration and compliance with federation or circuit requirements.

Information may need to be shared with relevant circuits, officials, timing providers, federations, insurers or other service providers where necessary for event administration.

Personal data will be handled in accordance with applicable data-protection legislation, including the GDPR where applicable, and the NSC Privacy Policy.

20. COMMUNICATIONS

Competitors are responsible for providing accurate contact information and for monitoring official NSC communications relating to their entry.

Important information may be communicated by email, through the NSC website, through official team communications or at the circuit.

Failure to read an official communication does not automatically excuse non-compliance with an applicable requirement.

21. ORGANIZER’S RIGHT TO REFUSE OR WITHDRAW AN ENTRY

For the avoidance of doubt, participation in the Northern Sidecar Cup is subject to acceptance by the Organizer.

Subject to applicable mandatory law and sporting regulations, the Organizer reserves the right to refuse an entry or withdraw an accepted entry where it considers this necessary or appropriate for the safe, lawful, fair or proper organization of the championship or an event.

This right may be exercised before or during an event.

Any refund following such refusal or withdrawal will be determined by the Organizer in accordance with Section 2 and applicable mandatory law and regulations.

22. RESPONSIBILITY OF THE ENTRANT

Where an entry is submitted on behalf of a team, the person submitting the entry is responsible for ensuring that the rider, passenger and relevant team members are informed of the regulations and conditions applicable to their participation.

The entrant must not knowingly provide false or misleading information when entering an NSC event.

23. SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

The affected provision shall be interpreted or limited as far as legally possible so as to preserve its intended purpose.

24. CHANGES TO THESE TERMS

The Organizer may amend these Terms & Conditions where reasonably necessary, including to reflect changes in legislation, sporting regulations, championship organization or event requirements.

The version applicable to an entry will normally be the version published or otherwise communicated in connection with that entry, subject to any mandatory subsequent regulatory or safety changes.

25. APPLICABLE LAW AND DISPUTES

The governing law, competent courts and any applicable dispute-resolution procedures should be determined according to the legal entity operating the Northern Sidecar Cup and the circumstances of the relevant event.

Nothing in these Terms & Conditions affects mandatory rights or legal protections that cannot lawfully be excluded by agreement.

26. ACCEPTANCE

By submitting an entry for a Northern Sidecar Cup event, the entrant confirms that:

1. the information provided in the entry is accurate;
2. the rider and passenger satisfy the applicable participation requirements;
3. the entrant, rider and passenger have read and accepted these Terms & Conditions;
4. they agree to comply with the applicable sporting, technical, safety and event regulations; and
5. they understand that acceptance of an entry remains subject to the Organizer’s rights and the authority of the relevant event officials.
